Definition of NBA Entities
NBA Properties, Inc., the National Basketball Association (the “NBA”), and the NBA member teams (collectively, the “NBA Entities”).
Exclusion of Employees of the NBA Entities from Eligibility
Employees of the NBA Entities, including affiliates, agents and immediate family members and/or those living in the same household of such employees, are not eligible to enter or win the [Build Your Team & Claim Rewards!] (the “Event”).
Limitation of Liability
The NBA Entities and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, representatives, and agents shall have no liability and will be released and held harmless from any claim, action, liability, loss, injury or damage, including, without limitation, personal injury or death to winner or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by any reason, including the acceptance, possession, use or misuse of the prize and/or participation in this Event.
Right of Publicity Release
Participants in this Event (if minor, his/her parent or legal guardian) agree to be bound by these Official Rules and agree that the NBA Entities and their designees and assigns may use the participant’s name, voice, city/state of residence, photos, video or film clips, and/or other visual likeness for advertising and/or trade purposes and/or for any other purpose in any media or format now or hereafter known without further compensation (financial or otherwise), permission or notification.
REQUIRED TERMS FOR DUNK CITY DYNASTY COMMUNITY EVENTS （NetEase）
Definition
“NetEase” refers to NetEase Interactive Entertainment Pte. Ltd, the publisher of Dunk City Dynasty (the “Game”).
“Community Events” or “the Events” refers to community events held by NetEase, titled [Build Your Team & Claim Rewards!], as published in the Game, on the Game’s official website or through the Game’s social media account from time to time.
Exclusion of Employees of NetEase from Eligibility
Employees of the NetEase, including affiliates, agents and immediate family members and/or those living in the same household of such employees, are not eligible to enter the Events.
Limitation of Liability & General Disclaimer
To participate in the Events, each participant agrees, to the fullest extent permitted by applicable laws and regulations, to release and indemnify NetEase and their affiliates, as well as their respective executives, directors, employees, and other representatives ("Released Parties") from any liability, and to waive any claims, costs, injuries, losses, or damages arising from participating in the Events or from receiving, delivering, accepting, possessing, or using any prize. This includes, but is not limited to, claims, costs, injuries, losses, and damages related to personal injury, death, property damage, violations of publicity or privacy rights, or defamation (intentional or not), whether based on contract, tort, warranty, or other legal theories. Participants hereby waive any right to bring lawsuits, request injunctions, or seek other equitable relief against the released parties regarding the Events, or its production, distribution, display, advertising, promotion, or publicity.
The Released Parties are not liable for any consequential, incidental, indirect, exemplary, special, or punitive damages to any participant or any individual/entity claiming rights from the participant. This includes loss of data, income, prizes, or profits due to breach/negligence or based on any other legal theories, whether or not there are foreseeable or whether NetEase or any affiliates/representatives have been informed of the possibility of such damages.
Each participant acknowledges the risks, dangers, and hazards associated with the Events and, to the fullest extent permitted by law, voluntarily accepts and fully assumes all such risks and the possibility of personal injury, death, property damage, or loss resulting from participating in the Event.
Each participant acknowledges and agrees that NetEase is not responsible for their property or personal safety. If participants feel the need to take out insurance, they should seek it from a third party.
Right of Publicity Release
Participants in the Events (if minor, his/her parent or legal guardian) agree to be bound by the Events’ official rules and agree that NetEase and their designees and assigns may use the participant’s name, voice, city/state of residence, photos, video, game footage recorded during the Events or film clips, and/or other visual likeness for advertising and/or trade purposes and/or for any other purpose in any media or format now or hereafter known without further compensation (financial or otherwise), permission or notification.
Non-Compete Restrictions
Participants shall ensure that their participation in the Events is not in violation with any agreements signed with third parties, including but not limited to non-compete agreements with other livestreaming platforms, game developers/publishers, etc.
If participants are held responsible by a third party for violating the aforementioned non-compete agreement, then NetEase shall not bear any responsibility. Participants shall bear all consequences arising from the violation of non-compete agreements, including but not limited to legal liability and economic losses.
Terms of Use and Privacy Policy
By participating the Events, each participant agree that you have read and fully understood our Terms of Use and Privacy Policy in their entirety and agree to be bound by them.
